Specific Terms and Conditions

APPLICATION OF THESE TERMS
- These Specific Terms must be read with the General Terms (available on our website at https://rytbank.my/terms-and-conditions) and any other relevant terms and conditions as we may impose from time to time with prior notice.
- By applying for or using or maintaining an Account, you are deemed to have read, understood and accepted these General Terms and Specific Terms.
- Some capitalised terms used in this document have been defined in the General Terms.
- In case of any inconsistency between what is stated in these Specific Terms and the General Terms, the terms in these Specific Terms shall prevail to the extent of such inconsistency.
- This document sets out the specific terms and conditions governing the accounts, products and services we may offer you from time to time (the Specific Terms). You must read and understand these Specific Terms carefully before opening any account or acquiring any product or service from us. Please reach out to us if you require any clarification.
A. SPECIFIC TERMS AND CONDITIONS APPLICABLE TO RYT BANK SAVINGS ACCOUNT
Protected by Perbadanan Insurans Deposit Malaysia (PIDM) up to RM250,000 for each depositor (PIDM Protection).

Account Opening
-
The opening of a Ryt Bank Savings Account (Savings Account) with us is subject to the Bank’s requirements including, without limitation, as to age, capacity, identification documents, account verification requirements, minimum initial deposit, and the minimum account balance to be maintained at all times. The Bank may have different requirements for different legal personalities.

Information on the eligibility requirements, minimum initial deposit and the minimum account balance are available in the Schedule hereto, on our App, and/or our website at https://rytbank.my. The eligibility requirements, minimum initial deposit and minimum account balance may be updated from time to time and can be viewed on our App and/or website at https://rytbank.my.

The Bank may allow you to open, maintain and operate only one Savings Account in your sole name for personal use. This means that each retail customer can only open one Savings Account at any one time. If the Bank becomes aware that you are maintaining more than one Savings Account, we reserve the right to close and terminate any additional Savings Accounts with notice to you.

An application for a Savings Account is subject to approval by the Bank. You understand and agree that we have sole and absolute discretion to determine whether to provide a Savings Account to you.

We reserve the right to reject any application (including any application that does not fulfil our criteria) and shall be under no obligation to provide any reason for or information in respect of any unsuccessful application.

For account verification purposes, you must fulfil the Savings Account funding requirement within 90 days from the date of account opening. Failure to do so may result in closure of your Savings Account.

You agree that you will only use your Savings Account for personal savings purposes. If your Savings Account is used for business purposes or purposes other than for personal savings, the Bank reserves the right to close your Savings Account and/or terminate the provision of any service or product to you.

Account and Services
-
The Savings Account is denominated in Ringgit Malaysia only.

You shall operate and administer the Savings Account in accordance with all applicable laws, rules, and regulations, as well as directives on international and domestic currency transactions including the foreign exchange policy (FEP) administered by Bank Negara Malaysia.
-
Prior to opening a Savings Account and as and when required, we may require you to provide relevant information and/or documents required for account opening, including to ensure compliance with the FEP and applicable laws and regulations.

Once a Savings Account is successfully opened and you fulfil the Savings Account funding requirement within 90 days from the date of account opening, you may perform fund withdrawals and fund transfers, denominated in Ringgit Malaysia only, to and from the Savings Account. Funds transferred into your Savings Account will be deposited into your Savings Account.

We may also impose a maximum account balance to be maintained in a Savings Account. Information on the maximum account balance, if any, is available on our website https://rytbank.my.

Where a limit has been imposed and the maximum account balance is reached, you agree that:
- you are responsible for ensuring that such limit is not reached; and
- where such limit has been reached, you agree that we, in our absolute discretion: (i) need not accept any Instruction or allow any transaction on the Savings Account, which would cause the balance to go above the maximum account balance; and/or (ii) may take any other action to ensure that the maximum account balance is not exceeded.

You agree that the Bank has the discretion to reject any Instruction on, or transaction through, the Savings Account.

Fees and Charges
- The Bank shall be entitled to impose fees and charges for any of the services provided to you. Please see Fees and Limits as set out at https://rytbank.my/fees-and-limits for details of the applicable fees, charges, and default interest rates. You agree that all applicable fees and charges may be debited from the Savings Account.

Interest
-
A Savings Account is an interest-bearing account. The Bank will pay you interest on the credit balance in your Savings Account at the applicable interest rate which is determined by the Bank and is subject to change from time to time (Interest Rate). Information on the Interest Rate is available on our website at https://rytbank.my and/or our Digital Banking Services.

Interest will be calculated daily based on the balance in your Savings Account at the end of each day, or using such other methods as the Bank may determine and notified to you from time to time.

The accrued interest will be credited to your Savings Account on a daily basis, when the accrued interest payable is at least RM0.01. The Bank will not credit any amount to your Savings Account if the accrued interest payable is less than RM0.01.

We reserve the right not to pay you any interest on the credit balance in your Savings Account if you breach any of your obligations under the Banking Agreement (including these Specific Terms).

Statements of Account
-
Electronic Statements in respect of your Savings Account will be generated on a monthly basis and will be made available through our Digital Banking Services.

The Bank may choose not to issue any Electronic Statement if your Savings Account is dormant or inactive.

Closure of Account
-
You may close your Savings Account by sending an Instruction to us via email to support@rytbank.my or telephone at +603-5115 5115.
-
You are responsible for any arrangement in relation to the transfer of any credit balance in the Savings Account before closure can be effected. We may stop paying interest on credit balance in your Savings Account from the day we receive your closure Instructions. Where we exercise our rights under Clause 24.2 (Our right to close, terminate or revoke any Product) of the General Terms to close the Savings Account, you agree that we shall have the right to transfer any unclaimed credit balance in the closed Account to our internal account(s).

Pending closure of the Savings Account, we may refuse to carry out any Instruction (including transfers or withdrawal of funds) or accept any further deposits. In appropriate cases, we have the right to limit the amounts deposited. We may also withhold or suspend payment of any funds.

No Cash Deposits
You will not be able to deposit physical cash or notes into your Savings Account.

No Cheques
No cheque book or facility will be issued for your Savings Account. You will not be able to deposit any cheques with us.

B. SPECIFIC TERMS AND CONDITIONS APPLICABLE TO SAVE POCKETS

Creation and Use of Save Pockets
-
Once a Savings Account is successfully opened, you will have access to Save Pockets, which are sub-accounts linked to your main Savings Account (Save Pockets) meant to encourage savings across different categories. We may automatically create a Save Pocket for you once we open your Savings Account and/or you activate your Savings Account.

You can then select Save Pockets from a list of pre-loaded labels most relevant to you based on your specific savings goals or purposes or create your own labels for each Save Pocket to best suit your needs. We will determine the maximum number of Save Pockets you may open and maintain and we will notify you of this from time to time.

Practically, the funds in each of your Save Pockets are maintained and kept separate from the funds in your main Savings Account and the funds in your other Save Pockets. A Save Pocket is akin to another Savings Account. You can transfer funds between and in and out of your Save Pockets, including to and from your main Savings Account. For the time being, you will not be able to make external fund transfers directly from the Save Pockets. You will also not be able to receive external fund transfers directly from external sources (including e-wallets). All terms and conditions governing the Savings Account also apply to the Save Pockets.

The Bank reserves the right to place a maximum limit on the amount of funds in each Save Pocket.

The amount of funds in each and every Save Pocket linked to your main Savings Account plus the amount of funds in your main Savings Account form the total of your protected insurable balance for the purposes of PIDM Protection.

Before the closure of your Savings Account, the credit balances in all your Save Pockets will automatically be transferred to your main Savings Account. All Save Pockets will then be automatically closed before closure of your Savings Account.

Interest Paid on Save Pockets
-
A Save Pocket is an interest-bearing sub-account. The Bank will pay you interest on the balance in your Save Pockets at the applicable interest rate which is determined by the Bank and is subject to change from time to time (Interest Rate). Information on the Interest Rate is available on our website at https://rytbank.my and/or our Digital Banking Services.

Interest will be calculated daily based on the balance in your Save Pockets at the end of each day, or using such other methods as the Bank may determine and notified to you from time to time.

The accrued interest will be credited to your Save Pockets on a daily basis, when the accrued interest payable is at least RM0.01. The Bank will not credit any amount to your Save Pockets if the accrued interest payable is less than RM0.01.

We reserve the right not to pay interest if you breach any of your obligations under the Banking Agreement (including these Specific Terms).

C. SPECIFIC TERMS AND CONDITIONS GOVERNING RYT BANK DEBIT CARD

APPLICATION FOR DEBIT CARD
-
Debit Card Terms: This section sets out the specific terms and conditions in respect of your application for, and the use of Debit Card (these Debit Card Terms). You must read and understand these Debit Card Terms and the Debit Card product disclosure sheet before applying for a Debit Card. Please reach out to us if you require any clarification on the feature of, or the terms applying to the Debit Card.

Acceptance and Acknowledgement: By applying for or using a Debit Card, you confirm you have read, understood, agreed to and accepted these Debit Card Terms.

Eligibility: An application for a Debit Card is subject to you meeting the following eligibility requirements:
-
you have opened and activated an Account to be the Designated Account, and the said Account is in good standing, not terminated, closed, dormant or delinquent;
-
you have not been declared bankrupt; and
-
you are not in breach or suspected to have breached any of the General Terms or Specific Terms.

DEFINITIONS
The following definitions apply unless otherwise stated:
ATM means an automated teller machine whether or not operated by the Bank. Authorised Merchant means an establishment supplying goods and/or services which accepts the use of the Debit Card for payment. Card-Not-Present means a Debit Card transaction effected without physically presenting the Debit Card (i.e. mail order telephone order transactions and online transactions). Card-Present means a Debit Card transaction that is not a Card-Not-Present transaction (e.g. transaction at POS and cash withdrawals at ATMs). Contactless means a feature available for the Debit Card to make transactions by tapping or waving the Debit Card at contactless readers or terminals at a POS terminal. Debit Card means a virtual or physical RYTBANK Visa and/or MyDebit debit card issued by the Bank to you for the purpose of making cash withdrawals or making payments out of the Designated Account or for any other purposes as specified herein. Designated Account means the Account designated by the Cardholder, as approved by the Bank, that is linked to the Debit Card for carrying out transactions. Dynamic Currency Conversion or DCC means an optional service offered by certain overseas Authorised Merchant or available for certain Overseas Transaction, which provides you with a choice to pay or withdraw cash in ringgit on the spot. MyDebit means a purchase made at a POS terminal installed at the payment counter of an Authorised Merchant that accepts a Debit Card and through the combined use of your Debit Card and PIN. Overseas Transaction means the use of a Debit Card to pay a foreign Authorised Merchant in foreign currency or, in the case where DCC is opted, in ringgit. PIN means your personal identification number selected by you. POS means point-of-sale. -
ISSUE, RENEWAL AND REPLACEMENT OF DEBIT CARD

Issue of Debit Card: If we approve your application:
-
a Debit Card will be made available to you in electronic format (including being made available in our App).
-
in addition to (a), at your request, we may issue a physical form of the Debit Card to your mailing address in our records for a fee as stated in our Fees and Limits at https://rytbank.my/fees-and-limits.
-
-
Activation: You must comply with such Debit Card activation, security and other procedures as may be prescribed by us before you can use the Debit Card.
-
Property of the Bank: A Debit Card remains our property at all times.
-
Non-transferrable: Your Debit Card cannot be transferred to another person.
-
Electronic Statement: Clause 5 of the General Terms (Electronic Statements and Records) is incorporated into these Debit Card Terms. For the purposes of these Debit Card Terms, you may, at your request, opt for a hard copy of the Electronic Statement.

Security measures and tips: We may provide guidance on how you can keep access to your Debit Card and/or PIN safe but this guidance shall not be taken as exhaustive of all reasonable precaution that you should take.

Replacement and charges: You may request for a Debit Card to replace an existing one:
-
upon its expiry;
-
that was lost or stolen;
-
that has become defective or damaged; or
-
that has been fraudulently used,
for a fee stated in our Fees and Limits as set out at https://rytbank.my/fees-and-limits. You will bear the replacement cost and you authorise the Bank to debit your Designated Account in respect of such replacement cost.

USE OF DEBIT CARD
-
Feature: The Debit Card is a payment instrument and an ATM card which can be used to:
-
make Card-Present transactions, including transacting at ATM, making payment at POS terminals of Authorised Merchants and pre-authorised transactions;
-
make Card-Not-Present transactions;
-
set up recurring payments;
-
make Overseas Transactions; or
-
effect any other transaction as we may notify you from time to time.
-
-
Use: You agree and acknowledge that:
-
you may only use your Debit Card for so long as it remains valid (please refer to the expiry date printed on your Debit Card or displayed in the App);
-
you must not use the Debit Card for or in connection with any unlawful activity;
-
we may refuse to approve your transaction made using the Debit Card in accordance with the General Terms; and
-
the use of the Debit Card is at your own risk and you assume all risks arising from the use of the Debit Card.

Funding:
-
You must ensure that there are sufficient funds in your Designated Account at all times for any transaction with your Debit Card.
-
When you perform a Debit Card transaction, we will debit the corresponding amount from your Designated Account.
-
We may earmark or place a hold on the Designated Account for the transaction amount (Earmarked Balance) either on the day it is presented for payment or on the day we receive notice of the transaction.
-
Your available balance in the Designated Account will be reduced by the Earmarked Balance. You may not stop payment on the relevant transaction nor use any sum designated as Earmarked Balance.
-
The amount of the Earmarked Balance and the duration for which it may be held shall be determined by us at our discretion.
-
If there are insufficient funds in your Designated Account, the transaction will be rejected and we shall not be liable in connection with such rejection.
-
Separate default daily limit will apply to:
-
cash withdrawal; and
-
payment for goods and services,
as may be amended by the Bank from time to time and which may be revised by you, via the Platform, subject to applicable limits imposed by the Bank. Please see our Fees and Limits available at https://rytbank.my/fees-and-limits for details.

Card-Present transaction: Your physical Debit Card may be used for Card-Present transactions, Contactless transactions, ATM withdrawals and such other transaction as we may notify from time to time. You agree that the entry of your PIN or signing of a sales draft shall be sufficient proof that you agree to the transaction and confirm the amount charged is correct. We shall not be held liable for any loss or damage if the wrong PIN is entered by you in the course of utilizing the physical Debit Card at an Authorised Merchant or an ATM.

Transacting at ATM: You may use the Debit Card for domestic and overseas (see “Overseas Transaction” below) cash withdrawals at an ATM and you agree to the following:
-
to check all debit or credit transactions. If any error or malfunction occurs, you must immediately contact our Customer Service Centre.
-
the entry of your PIN at the ATM shall be sufficient proof that the transaction has been made by you.
-
you are liable for all fees and charges arising from such withdrawal or transaction at the ATM, which may vary depending on whether it is a domestic or overseas cash withdrawal.
-
the Debit Card may be retained or blocked when the following are detected:
-
exceed maximum PIN tries;
-
invalid card authentication value;
-
the Debit Card unable to eject;
-
“deactivated”Debit Card status;
-
where your Designated Account is inactive) such as “Dormant” or “Deceased”); and
-
where the Debit Card is tagged as “Lost” or “Stolen”.

Payment at POS terminals of Authorised Merchants: You may use the Debit Card for purchases at POS terminals of Authorised Merchants:
- you agree that:
-
a transaction is permitted if it is within the limits determined by the Bank, from time to time. You may increase or reduce certain amount limits up to the Bank’s specified limits as stated on our website at https://rytbank.my/fees-and-limits by giving instructions via the Platform.
-
you will bear all fees and charges as stated in our Fees and Limits as set out at https://rytbank.my/fees-and-limits for that transaction, which will be deducted from your Designated Account.
-
you acknowledge that:
-
a Debit Card will incorporate a feature which enables the Debit Card to be used for Contactless transaction. This means that you will not be required to swipe the magnetic stripe of your Debit Card, sign any sale draft nor enter a PIN to authorise the transaction.
-
the use of the Debit Card for Contactless transactions without a PIN for each retail transaction performed in Malaysia is limited to a maximum of RM250or any other amount as may be specified by the Bank at any time. You must use your PIN for any payment of more than RM250. The maximum limit for a retail transaction performed in any other jurisdiction is subject to the limit prescribed in the respective country.

you may enable or disable use of the Debit Card for Contactless transactions via the Platform.
-
all Contactless transactions are deemed properly authorised by you unless you can show evidence to the contrary.

- you agree that:
-
Pre-authorised transaction: Certain Authorised Merchants may require a pre-authorisation of a Debit Card transaction. A pre-authorisation is not a charge but the Designated Account balance is temporarily reduced by the pre-authorised amount. An amount in the Designated Account balance will be held for the following pre-authorised transactions until the transactions are concluded:
-
at an automated fuel dispenser (AFD) for petrol transactions, RM200 will be held from your Designated Account and the pre-authorised amount will automatically be released three (3) Business Days after the transaction date.
-
for any non-AFD transaction, the pre-authorised amount is the transaction amount which may be held from your Designated Account and the pre-authorised amount will automatically be released thirty (30) days after the transaction date.

Card-Not-Present transaction:
-
You shall not be allowed to perform any Card-Not-Present Transaction unless you have instructed us to opt-in and activate this feature via the Platform. Where you have opted-in and activated a Debit Card, such Debit Card may be used for Card-Not-Present transactions. Once you have activated this feature, you can always disable it subsequently by de-activating this feature via the Platform.

You understand that there are risks involved when performing a Card-Not-Present transaction.
-
You agree that the entry of the Debit Card information and your Card Verification Value/ Code (CVV/CVC) or any other form of additional confirmation at the internet site or mobile application shall be sufficient proof that you have authorised that transaction.
-
We shall not be under any obligation to verify the identity or the authority of the person entering the Debit Card information and CVV/CVC.

Recurring Payment:
-
If you authorise an Authorised Merchant to effect recurring payment through the Debit Card, the Bank is entitled to act on the instructions without further reference to you.
-
Payments will only be made if there are sufficient funds in your Designated Account.
-
We do not guarantee that payment will be made on a timely manner.
-
We may refuse to make any payment at the Bank’s discretion by written notice to you.
-
It is your responsibility to inform the applicable Authorised Merchant if there is any change to the details of your Debit Card.
-
You acknowledge that no payment will be made if your use of the Debit Card is terminated or suspended for any reason whatsoever or where an expired Debit Card is not renewed.
-
You shall at all times remain liable and responsible to pay the Authorised Merchant. In the event of non-payment by the Bank, you shall resolve and effect payment with the Authorised Merchant directly.

Overseas Transactions:
-
You shall not be allowed to perform any Overseas Transaction unless you have instructed us to opt-in and activate this feature via the Platform. Where you have opted-in, your Debit Card maybe used for Overseas Transactions (but only in countries acceptable to us).
-
You may only use the Debit Card for Overseas Transactions in compliance with foreign exchange policy administered by Bank Negara Malaysia applicable to you and the transaction. All Overseas Transactions are subject to the laws existing in the country where the transaction originates.
-
You may be given the option to use DCC service for certain Overseas Transactions. The transaction amount will be debited from the Designated Account after conversion to ringgit at the exchange rate and at such time as may be determined by the applicable overseas Authorised Merchants and ATM where you have opted to use the DCC service. The conversion rate for DCC may be higher than the conversion rate determined by Visa.

If you use the Debit Card to carry out a transaction in a currency other than ringgit, the transaction amount will be debited from the Designated Account after conversion to ringgit at the exchange rate and at such time as may be determined by Visa.

You will also be charged a Overseas Transaction fee by the Bank, as set out in our Fees and Limits as set out at https://rytbank.my/fees-and-limits.

Bank not involved in Debit Card disputes:
-
We are not responsible and will not be liable for any act or omission of any Authorised Merchant including any refusal to honour the Debit Card or any defect or deficiency in any goods or services supplied to you.
-
You must resolve all complaints, claims and disputes against any Authorised Merchant directly and you agree not to involve us in any such claim, dispute or legal proceedings.
-
We are entitled to debit your Designated Account for the transaction amount even if you have a dispute with an Authorised Merchant.
-
We shall not be liable for any payment remitted to an Authorised Merchant not with standing any claim and/or dispute that you may have against that Authorised Merchant.

YOUR RESPONSIBILITY
-
You must keep your Debit Card safe: You shall observe all security measures prescribed by the Bank relating to the Debit Card.
-
Security responsibility: In addition to Clause 7.3 (Security Responsibilities)of the General Terms, you must take reasonable steps to keep the Debit Card and PIN secure at all times including, without limitation:
-
to abide by these Debit Card Terms for the use of your Debit Card.
-
not use the Debit Card when you suspect or become aware that the Debit Card or the PIN is lost (even though it is found subsequently), stolen (even though it is recovered subsequently), breached or compromised or someone else knows the PIN.
-
not allowing any other person to use the Debit Card.
-
not disclose details of the Debit Card or the PIN to any other person.
-
not write down the PIN on the Debit Card, or on anything kept in close proximity with the Debit Card.
-
ensure that the transaction amount is correct before signing any voucher or transaction record and before entering your PIN for any transaction which requires the entry of your PIN. The affixation of your signature or entry of your PIN is deemed your agreement to the transaction and confirmed the amount is correct.
-
securely dispose of any receipt or document issued by the Bank concerning your PIN.
-
ensure that the Debit Card is returned to you after completing the transaction whether at the Authorised Merchant or the ATM.
-

Duty to notify: In addition to Clause 7.4 (You must immediately report) of the General Terms, you must immediately inform the Bank by contacting our Customer Service Centre (the contact number is indicated at the back of a physical Debit Card) or by notifying us via the Platform when you:
-
suspect or become aware of any suspicious or unauthorised transaction or unauthorised use in relation to the Debit Card.
-
suspect or become aware of any fraudulent or unlawful activities in relation to the Debit Card.
-
suspect or become aware that your Debit Card and/or Security Credential PIN is lost, stolen, breached or comprised or someone else knows the PIN.
-
receive a short message service (SMS) alert of an unauthorised transaction.
-
discover any errors, irregularities, unauthorised or fraudulent transaction in an Electronic Statement relating to your Designated Account to which the Debit Card is linked to.
-
change your personal particulars and any other previously particulars disclosed to us including your residential and/or mailing address, your email address and your contact number(s).
-

Making police report: In relation to any unauthorised or fraudulent transaction, we may require you to provide to the Bank a police report within reasonable time from the date of the loss and/or theft of the Debit Card and/or disclosure of the PIN to a third party. You shall also provide relevant information and reasonable assistance as the Bank may require in any investigation on the incident.

No liability on part of Bank: In addition to Clause 9 (Liability for Transactions) of the General Terms, the Bank also shall not be liable for any loss suffered by you from any unauthorized transactions that resulted from your not complying with the security measures advised by the Bank or your unreasonable delay in notifying the Bank of the loss or theft or negligence in disclosure of any Debit Card details or PIN.

YOUR LIABILITY FOR TRANSACTIONS

You are liable for all transactions: Unless otherwise stated herein, you shall be liable to us for all transactions(including relevant fees and charges) performed using the Debit Card. Any transaction made using your CVV/CVC, transaction signing, or any other form of additional confirmation shall be deemed as evidence that you have authorised the transaction. If the Debit Card has been misused, lost or stolen or that PIN have been breached and the Debit Card is used to carry out unauthorised transactions, you shall be liable for all unauthorised transaction until the date and time of receipt by the Bank of your notification under Clause 6.3 above.

Your liability for unauthorised transactions: You shall be liable for any unauthorised transaction, including but not limited to Card-Present transaction which requires PIN or signature verification or the use of Contactless function, if you have:
-
acted fraudulently;
-
delayed in notifying us as soon as reasonably practicable after having discovered the loss or unauthorized use of the Debit Card;
-
left the Debit Card or an item containing the Debit Card unattended, in places visible and accessible to others, including your place of residence;
-
voluntarily allowed another person to use your Debit Card; or
-
recorded your PIN on the Debit Card, or on anything kept in close proximity with your Debit Card.

Chargeback: where there is a dispute, you may be entitled to a chargeback in certain circumstances, if you have not been found liable pursuant to clause 7.2.

In certain circumstances, the card scheme rules may allow you to charge a transaction back to the Authorised Merchant with whom the transaction was made, subject to your fulfilment of the requisite conditions, including:

raising a dispute in writing within sixty (60) days’ from the posting date of such Debit Card transaction as shown in the Electronic Statement; and
-
providing all relevant supporting documentation as requested by us within the permitted time frame.

You agree to provide us with any information that we reasonably request to facilitate our investigations into the Debit Card transaction, and to make a police report if we reasonably request such a report to be made to facilitate the claims investigation process.

Subject to our investigation, we will raise the chargeback to the Authorised Merchant for the Authorised Merchant to carry out its own investigation.

We may credit your Designated Account with the amount of the disputed Debit Card Transaction after completing our investigations.

We will reject disputes which are found to be false or where the dispute is due to your own negligence. If payment for such a dispute has already been made to you, that payment must be refunded to the Bank and all expenses incurred in the investigation and in recovering the payment shall be borne by you. You here by authorise us to debit your Designated Account for such payment and expenses that must be so refunded to the Bank.

The Bank reserves the right to institute legal action and/ or any other proceedings as we may deem necessary against you if you obstruct and/or withhold information, make or attempt to make false claims in respect of any transaction, publish false claims, in connection with or arising from the disputed Debit Card transaction.

Bank’s record of Transactions binding: You agree that our record of any transaction effected by the use of the Debit Card shall be conclusive and binding evidence that such Transaction is properly effected by you.

Provisional credit: If we are required by Applicable Laws to make a provisional credit to your Designated Account to which the Debit Card is linked to pending the conclusion of any investigation or resolution of a disputed transaction, we will make such provision credit on the basis that you will refund the provision credit in full in the event that you are found to be fully liable for the disputed transaction (or refund the provision credit in part if you are partially liable for the disputed transaction). We shall be entitled to debit any of your Designated Account maintained with the Bank to effect the refund. If there is insufficient funds in your Designated Account, we may, after giving you a reasonable period to settle the shortfall, initiate a debt recovery process to recover the shortfall.

Our rights: We reserve the right to commence and institute legal action as we deem necessary against you if we discover or become aware of any false, fraudulent or unlawful claims in connection with or arising from, the disputed Debit Card transaction.

FEES AND CHARGES
The Bank shall be entitled to impose fees and charges for any of the services provided to you. Please see Fees and Limits as set out at https://rytbank.my/fees-and-limits for details of the applicable fees, charges, and default interest rates. You agree that all applicable fees and charges may be debited from the Designated Account.

YOU MAY FREEZE YOUR DEBIT CARD
You may:
-
temporarily freeze the use of your Debit Card;
-
uplift the temporary freeze and reactivate your Debit Card; or
-
terminate your Debit Card,
at any time in accordance with the procedures prescribed by us. We shall not be responsible for any loss that you may incur as a result of your taking any action in (a), (b) or (c).

TERMINATION OR CANCELLATION OF DEBIT CARD

Termination, cancellation and suspension: We reserve the right to terminate or cancel your right to use your Debit Card at any time in accordance with Clause 24 (Termination / Closure of Account) of the General Terms, or suspend your account at any time in accordance with the General Terms. The termination or cancellation of a Debit Card is not and will not constitute any reflection on your character or creditworthiness and we shall not be liable in any way for any statement made or deemed made by the termination or cancellation.

Bank may cancel an unused Debit Card: We reserve the right to cancel any Debit Card that has not been used to carry out a withdrawal or purchase within such period prescribed by us. Issuance fee for new Debit Card will apply if you later request for a Debit Card and such fee will be debited to the Designated Account.

Effect of cancellation or termination of Debit Card: Upon closure of your Designated Account or cancellation or termination of your Debit Card:

you must immediately cease all use of the Debit Card via any means, cut any physical Debit Card in half so that the magnetic strip and hologram are no longer intact and securely dispose your physical Debit Card.

all accrued rights and liabilities under these Debit Card Terms shall continue to remain in full force and effect and shall survive any cancellation, restriction or suspension of the Debit Card until their full discharge and settlement.

you agree to waive your right of refund of any fees charged for the unexpired term of the Debit Card.

EXCLUSION OF LIABILITY
You agree not to hold us liable in anyway whatsoever by reason of any loss, damage, or injury howsoever caused or if the Debit Card is not honoured due to any mechanical defect or malfunction of any ATM, POS terminal, internet network or such other terminals or channels that is available to you or due to a loss or interruption of power supply.

ADDITIONAL BENEFITS, SERVICES OR PROGRAMMES
We may provide at our sole discretion, additional services, benefits, discounts or programmes in connection with the use of the Debit Card. Any such additional services, benefits, discounts or programmes will be subject to separate terms and conditions governing such additional services, benefits, discounts or programmes.
We may also partner with or introduce you to Authorised Merchants who offer or make available to you such additional services, benefits, discounts or programmes. The Bank is neither responsible nor liable for the acts of any Authorised Merchants or other person, or for any additional services, benefits, discounts or programmes that are offered by such Authorised Merchants or other person.
